CPSIA

Aakron Rule Corporation has always cared about their customers; striving to bring the best and safest products to the promotional industry. Lately there has been a lot of talk about the new laws affecting our industry (i.e. CPSIA & California Proposition 65) and we would like to keep you informed as to how we are handling the situation. Below are the steps that Aakron Rule Corporation is taking to comply with CPSIA regulations:

Every product in our catalog has been tested with XRF technology to determine lead content. Any item that has returned an inconclusive result has been sent out for Third Party testing. This will be done on an annual basis or if a products composition/supplier changes.

Every children’s toy we carry has had Third Party Testing by a CPSC certified laboratory to determine phthalate content as well as lead in surface coatings and in the product.

Every product in our catalog has a General Conformity Certificate. These certificates can be obtained on our website (www.aakronline.com) by signing on under your distributor name and clicking on ‘General Conformity Certificate’ link at the bottom of each products page. Logging on is necessary due to our contact information that is supplied on the certificates as required by law. To request further test reports, please contact our Product Test Coordinator Ali Krieger (akrieger@aakronline.com).

Any children’s toy manufactured after August 2009 will have tracking information on the product as per CSPIA regulations.

To check if there has been a recall on any of our children’s toys, please go to http://ps.ppa.org/ , and type in the tracking information found on the toy. If the toy has been recalled for any reason, that reason will show up here in Red letters. If the toy has not been recalled, it will provide basic information on that toy as well as contact information in case of the need for further information.

For any further information you may require, please contact our Product Test Coordinator:

CALIFORNIA PROPOSITION 65

PROPOSITION 65:
Also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, California Proposition 65 is a law that requires warning to consumers if a product exposes consumers to a wide variety of chemicals including lead and cadmium. Prop 65 does not ban any product; it simply requires warnings. Prop 65 applies only in California, and covers all products distributed in the state. Please note-AAkron Rule complies with all Federal Regulations concerning chemical contents. The State of California requires significantly stricter standards be met. CALIFORNIA PROPOSITION 65 ("Prop 65") COMPLIANCE
The State of California requires that no person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the State of California to cause cancer or reproductive toxicity without first giving a clear and reasonable warning. Accordingly, if Buyer and/or Distributor fail to provide AAkron advance written notice that AAkron's product will be sold or shipped to the State of California, Buyer and/or Distributor hereby indemnifies and agrees to defend and hold harmless AAkron, its agents, employees, representatives and affiliated companies, from and against any and all Proposition 65, personal injury and property damage claims, and from all other costs, liabilities, damages and expenses (including, without limitation, attorneys fees and litigation expenses on account thereof or in connection with any investigation or preparation related thereto or the enforcement of this provision) relating to, resulting from, connected with or arising out of goods or products provided to buyer by AAkron, to the maximum extent permitted by law.

Any order placed with or received from AAkron, including but not limited to orders placed via catalog, online, phone or mail, shall be deemed effective acceptance of these terms.

PROP 65 SURCHARGE:
To ensure compliance with Proposition 65, products entering the State of California must include a warning label, applied to each item. Add $.12/ea. (G).
